Tenant Obligations
Using, possessing, selling, or manufacturing methamphetamine is an offence under the Misuse of Drugs Act 1975. Tenants who use or manufacture meth in a rental property are using the premises for an unlawful purpose and may also be liable for intentionally or carelessly causing meth contamination. In some cases, the Tenancy Tribunal may order penalties of up to $1,000, in addition to holding tenants responsible for remediation costs.
Landlord Responsibilities
Landlords may carry out meth testing during a tenancy, provided the appropriate notice requirements are followed before entering the property. At the beginning of a tenancy, additional clauses relating to meth testing and decontamination may also be included in the tenancy agreement, provided they comply with the Residential Tenancies Act.
